--Under Rule 869 (2) (a) Stipendiary Steward Mr McIntyre alleged that Driver R Needham, (LUV ON THE RUN), used his whip excessively in the run home.
--Mr Needham admitted the charge and chose to be present.
--Video evidence of the alleged offence was shown. It showed Mr Needham after trailing hit his horse over 20 times in the run home. He finished 4th. The exact number of hits was complicated by Mr Needham's horse going out of shot about 50 metres from the line. He agreed he had hit the horse at least 24 times. Head on camera views confirmed this.
--As he admits the charge I find it proven under Rule 1111 (1) (d).

PENALTY
--Submissions as to penalty were heard. Mr Needham had no charges of any type in the past 12 months and Stipendiary Steward Mr Ydgren asked for a fine of about $200 or a suspension of up to and including about the 17th of May - about 4 days. Mr Needham drives mainly only in the local area and currently has 1 or 2 horses at the races. Mr Needham said he preferred the fine.
--Taking Mr Needham's good record, ready admission of the charge and his preference for a fine I fine him $200.00.
