Following the running of race one the Stipendiary Stewards lodged an information instigating a charge against Mr C V Leveque under Rule 871 (1) (d).

DECISION & REASON
--Following the running of race one the Stipendiary Stewards lodged an information instigating a charge against Mr C V Leveque under Rule 871 (1) (d). The Stipendiary Stewards alleged that Mr Leveque, the rider of Black Eagle, allowed his mount to move inwards with approximately 2,700 metres to run, when not sufficiently clear causing Tawnce (A C Browne) to be checked.
----At the commencement of the hearing the Committee sought and received from the Defendant confirmation that he understood the proceedings and that his plea was admitted.
----The Stipendiary Steward then read the rule and with the assistance of the video evidence demonstrated the incident the subject matter of the information.
----The Stipendiary Steward stated, and this was accepted by the Defendant, that the Defendant had allowed his mount, Black Eagle, to move in when not the sufficient distance clear of Tawnce and as a result A Browne had to take hold of his mount Tawnce and it lost ground.
----In respect of penalty the Stipendiary Stewards informed the Committee that Mr Leveque over the past two seasons had approximately 20 rides in New Zealand and this was the first time he had appeared before a judicial committee in respect of any matter. A fine only was recommended by the Stipendiary Stewards and Mr Leveque advised the Committee that he agreed with the Stipendiary Stewards submission as to penalty.
----The Committee, after taking into account the following mitigating facts:

- Mr Leveque's good riding record and that the interference was at the low to middle end of the scale, and --

Agrees that the proper penalty on this occasion after also taking into account riding opportunities in the South Island is a fine only and after giving consideration to the mitigating factors a fine of $350.00 is imposed.
