Following the running of race 8 an information was lodged by the Stipendiary Stewards alleging a breach of rule 869 (6) (b) and (c) in that Downtown Lady (K Deuart) forced Simple Plan (J R Dunn) to race wider on the track with approximately 1100 metres to run.

Following the running of race 8 an information was lodged by the Stipendiary Stewards alleging a breach of rule 869 (6) (b) and (c) in that Downtown Lady (K Deuart) forced Simple Plan (J R Dunn) to race wider on the track with approximately 1100 metres to run.

The relevant rule reads:

--

Rule 869 (6)

--

            Subject to sub-rule (4) hereof:

--

(b)   a horse making a forward movement during any race shall not be forced to race wider on the track;

--

 

--

(c)    a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

At the outset of the hearing the Committee noted that the defendant admitted the breach and did not wish to attend the hearing.

The Stipendiary Stewards showed the video evidence of the incident which clearly showed Mr Deuart, who was racing two off, forcing Simple Plan out four wide while that horse was racing on its outside and about half a length back from the nose of Downtown Lady.

The Stipendiary Stewards advised the Committee that Mr Deuart had no similar offence over the last twelve months and recommended a monetary fine only. The Committee, after taking into account the submissions, agrees that a monetary fine is appropriate and, accordingly, Mr Deuart is fined the sum of $200.00.
