Facts:

Following the running of Race 5, the Sim’s Bakery 1200, Stipendiary Steward, Mr M Davidson, filed an Information instigating a protest, under Rule 642(1) in that GRANITE RIDGE, ridden by Mr R Mudhoo, placed second by the Judge, interfered with the chances of ROMANTIC WHISPER, ridden by Mr K Mudhoo, placed third by the Judge, alleging interference over the concluding stages. The official margin between second and third was a nose.

Submissions for Decision:

Informant, Mr Davidson, with the assistance of Chief Stipendiary Steward, Mr J Oatham, showed the available films showed the alleged interference from the 400m. He pointed out GRANITE RIDGE, ridden by Mr R Mudhoo, with ROMANTIC WHISPER, ridden by Mr K Mudhoo, positioned on the outside of GRANITE RIDGE. Mr Oatham pointed out GRANITE RIDGE laying out and under a ride from Mr Mudhoo. He said that GRANITE RIDGE shifted out at least 4 to 5 horse widths over the concluding stages and dictated ROMANTIC WHISPER outwards over that distance. Mr Oatham showed contact between both runners due to the outward movement of GRANITE RIDGE on two occasions over the concluding stages with the final contact being a stride or so before the winning post. He added that ROMANTIC WHISPER was placed into very restricted room just short of the line and contacted, with the official margin at the line being a nose. Mr Oatham added further that Mr K Mudhoo was unable to ride ROMANTIC WHISPER out to full effect over the concluding stages.

Mr K Mudhoo, Rider of ROMANTIC WHISPER, stated that he was positioned outside GRANITE RIDGE and was dictated out over the concluding stages with contact on two occasions. He said that he believed that the interference cost him running into at least second place.

Miss T Rae, Trainer of ROMANTIC WHISPER, stated that her horse had been intimidated the whole way down the straight and contacted on two occasions with the last one just short of the line twisting her horse sideways with this having an effect on her horses chances, especially with the margin being only a nose.

Mr R Mudhoo, Rider of GRANITE RIDGE, stated that his mount was hanging out from the 500m. He said he had to stop riding his horse out to straighten him on two occasions but kept riding the horse out over the concluding stages to do his best for the connections.

Reasons for Decision:

This Committee carefully considered the evidence presented and the video coverage of the alleged incident. The Committee was satisfied that after turning for home and inside the 400m, GRANITE RIDGE, began a shift outward, whilst hanging, dictating ROMANTIC WHISPER over the concluding stages with the shift out being estimated at 4 to 5 horse widths. The Committee was also satisfied that contact was made near the 300m and again firmer contact closer to the line, approximately a stride short. The Committee was further satisfied that ROMANTIC WHISPER suffered interference to an extent that its chances were affected. After taking all factors into consideration including the dictation out over the final stages, the two points of contact, the official margin of a nose and factoring in the balance of probabilities, determined that ROMANTIC WHISPER would have beaten GRANITE RIDGE but for the interference received from that horse over the concluding stages.

The Committee therefore determined that this protest be upheld with GRANITE RIDGE being relegated to third place.
