Facts:
Following the running of Race 6, Plumbing World Fillies & Mares Maiden 1200, an information was filed by Stipendiary Steward Mr Davidson, against Licensed Apprentice Jockey, Mr S Yusoff, alleging a breach of Rule 638 (1) (d) in that Mr Yusoff, as the rider of "Zoe Brook" in the race, “…allowed his mount ("Zoe Brook") to shift out when not clear causing ("Savannah Al Jamal") to check losing ground passing the 200 metres.”
Mr Yusoff was present at the hearing and indicated that he admitted the breach. He was assisted at the hearing by Licensed Trainer, Mr P Richards.
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless”
Submissions for Decision:
Stipendiary Steward, Mr Coles, with the assistance of the Race Video illustrated how Mr Yusoff’s mount, “Zoe Brook”, had been travelling inside “Savannah Al Jamal” at about the 200 metre mark when Mr Yusoff switched his whip to his left hand. Under the ride from this stage “Zoe Brook” moved out sharply, crossing “Savannah Al Jamal” when not sufficiently clear.
He submitted as a consequence Mr Cameron, the rider of “Savannah Al Jamal” which had been improving at the time, had to take hold of his mount. He added “Savannah Al Jamal” was entitled to the racing line she was on and had lost momentum as a result of the check. He also observed that track conditions may have contributed to “Savannah Al Jamal” being unable to regain her momentum following the check.
It was evident from the race video Mr Yusoff had failed to take timely action to avoid crossing “Savannah Al Jamal” when not sufficiently clear of that horse.
Mr Yusoff, through Mr Richards, accepted the Stipendiary Stewards submissions.
Submissions for Penalty:
Mr Davidson said Mr Yusoff, who commenced riding in September 2011, had one previous breach of this rule in April 2012, and he considered him to be developing into a promising jockey. That he considered the breach to be in the mid to low category and submitted a penalty of 2 – 3 days suspension would be appropriate. He confirmed Mr Yusoff confined himself to riding at South Island meetings.
Through Mr Richards, Mr Yusoff accepted Mr Davidson’s submissions. He asked for any suspension to be from the completion of racing at Timaru on 13th July 2012 to enable him to take prospective rides arranged for that meeting.

The Committee determined a starting point of 5 days suspension as appropriate.
We took into account Mr Davidson’s submissions that Mr Yusoff was an apprentice jockey, with less than 12 months riding experience, who was continuing to develop his skills, showing promise and having a good record overall. We took into account Mr Yusoff’s early admission of the breach and accepted the breach as being in the low to medium range.
Accordingly we considered a suspension of 2 South Island racing days as appropriate penalty.
