Charge:
Alleged breach of Rule 638(1)(d) - Careless riding
Facts:
Following the running of Race 10, the Robbies Bar & Bistro Ashburton Rating 75 1600m, an Information was filed by Stipendiary Steward, Mr M Zarb, against Apprentice Jockey, Mr J Wong, the rider of PAMINA alleging careless riding shortly after the start.
The charge reads as follows:
“I the above named Informant, allege that the above named Respondent, committed a breach of Rule 638(1)(d) in that shortly after the start J Wong (PAMINA) shifted ground inwards and made contact with BLACK STOCKINGS (T Moseley), which in turn made contact with KEEPA TRAMP (M Cameron), which made contact with THE CORDONIAN (R Doherty) which was crowded and clipped a heel and blundered.”
Rule 638(1)(d) reads as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Wong had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Mr Wong also agreed that he understood the charge and the Rule it was brought under. As Mr Wong was an Apprentice Jockey, Mr M P McCann, trainer, assisted him during the hearing.
Submissions for Decision:
Mr Zarb gave evidence and used video coverage to show that shortly after the start Mr Wong riding PAMINA shifted ground inwards when not clear and made contact with BLACK STOCKINGS (T Moseley), who in turn made contact with KEEPA TRAMP (M Cameron), who in turn made contact with THE GORDONIAN (R Doherty), who was crowded clipping heels, nearly falling. Mr Zarb stated that Mr Wong had not shifted in a great deal, probably only a horse width, but with the concertina effect on the horses on Mr Wong’s inside and with THE GORDONIAN being slighty behind the other 3 runners, was crowded and clipped heels, nearly falling. Mr Zarb also stated that Mr Wong had taken corrective measures albeit too late.
Mr Wong nor Mr McCann did not dispute the facts presented by the Stipendiary Stewards but Mr McCann submitted that Mr Wong had realised what he had done and had tried to pull off, albeit too late.
Reasons for Decision:
As Mr Wong had admitted this breach of the Rules it was found to be proved.
Submissions for Penalty:
Mr Zarb stated that Mr Wong had a good record and had not been before a Judicial Committee since he had started riding. He had, up to today’s meeting, 22 rides as an Apprentice Jockey so was a relatively inexperienced rider. In addition he submitted that Mr Wong should be given credit for his ready admission of the breach. He also submitted that in the Stewards' opinion the degree of carelessness was at the lower end of the scale; however the consequential effects of his carelessness was high. Mr Zarb stated that Mr Wong would learn from his mistake and submitted that a minimal term of suspension should be considered as penalty.
Mr Wong and Mr McCann made no submissions on penalty apart from advising the Committee that a deferment of penalty was not sought.
Reasons for Penalty:
In determining penalty the Committee took into consideration Mr Wong’s good record, his relative inexperience and his frank admission of the breach. The Committee also determined that the breach was at the lower end of the scale of carelessness but consequential effects of the carelessness were at the higher end. After taking all mitigating factors into consideration, the fact that he was a South Island Apprentice, only riding in the Southern District and penalties given for similar breaches of this Rule, the Committee determined that a suspension of two riding days was appropriate on this occasion.
