The Committee declares “Game of Thrones” to be a non-starter. Authorisation is given to the payment of amended dividends.

Facts:

Following the running of Race 5, the “Rural Transport Maiden 1400”, Information A6151 was filed by Stipendiary Steward Mr N Ydgren seeking a request for a ruling under Rule 632. The Information said “Barrier 2 did not open correctly denying “Game of Thrones” a fair start”.

Rule 632 states “If, in the opinion of the Judicicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.

Mr Ydgren used the head-on film of the start of the race to highlight “Game of Thrones” who was drawn in barrier 2. He said as the gates opened “Game of Thrones” jumped out but was immediately struck by the right hand side of the gate which bounced back into the horse’s head which meant Mr Bates had to barge his way out of the gate. He used the side-on film to show how Mr Bates had been impeded and had lost ground on all other runners.

Mr Bates agreed with the comments of Mr Ydgren and added that when his horse was struck it was momentarily pushed sideways and he, as the rider, became unbalanced for a couple of strides.

Reasons for Decision:

The Committee carefully considered the films of the start and submissions of both parties. The Committee is satisfied “Game of Thrones” was denied a fair start having been struck in the head by the right hand side of its starting gate which bounced back and hit the horse as it jumped from its barrier. The Committee notes that the horse did not finish in the first 6 placings.
