As Ms Spittles admitted the breach the charge is proved.

Ms Spittles is suspended for 2 riding days from the close of racing today, Friday 04 July 2014 to the close of racing on Sunday 20 July 2014 – the 2 days being Timaru (11 July) and Oamaru (20 July).

Facts:

Following the running of race 3 the “Paul Summerfield Plumbing Maiden 1200”, Information A6153 was filed by Stipendiary Steward Mr N Ydgren under Rule 638(1)(d). The Information stated “you allowed your mount “Czarista” to shift inwards nearing the 900m when not clear of “Spider Lily” (S Kelly), “Gild The Lily” (J Morris) and “Chapelle D’Or” (R Black) causing these runners to check and be steadied”. Ms Spittles signed the Information stating she admitted the breach and at the beginning of the hearing confirmed that was correct and also that she understood the rule under which she was charged.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.

Submissions for Decision:

Mr Ydgren, using the head-on film of the back straight, highlighted Ms Spittles as the widest runner on the track as the horses were approaching the 900m mark. To her inside and slightly behind was Ms Kelly and to her inside was Ms Morris and on her inside was Ms Black. He said Ms Spittles could be seen to shift inwards and crowd Ms Kelly. He then showed the side-on film at the time the inwards movement of Ms Spittles to highlight that she was not the required 1 length and another clear of Ms Kelly. He then went back to the back straight view to show Ms Morris having to steady because of the pressure she received from Ms Kelly and the consequential impact on Ms Black.

Ms Spittles said she was pushing forward and when she realised she could not get to where she wanted to be came off her line too sharply and caused what she considered to be minor interference. She said she was not denying it happened but thought she was clear as she didn’t hear anybody calling out.

Submissions for Penalty:

Mr Ydgren said Ms Spittles had not breached this Rule in the previous 12 months but had rarely ridden during that time. He said that Ms Spittles only rode in the South Island. He said the Stewards considered the severity of the interference to be at the low end because she had only slightly underestimated the room available to her. Mr Ydgren concluded by saying consideration should be given to Ms Spittles admitting the breach and he submitted that a suspension of 2 riding days was an appropriate penalty.

Ms Spittles had no comments to make and said she did not seek a deferment of any suspension that might be given. To a question from the Committee she confirmed she had renewed her jockey’s license for the 2014/2015 season.

Reasons for Penalty:

The Committee has reviewed films of the incident and taken into account all the submissions made. The films clearly show that approaching the 900m at the end of the back straight Ms Spittles commenced to move in from a position widest on the track and in doing so, because she was not the required distance in front of Miss Kelly on “Spider Lily” to her inside, caused that horse to have to be steadied which in turn created a concertina affect with “Gild The Lily” and “Chapelle D’Or” who were racing on the inside of “Spider Lily” being checked.

The JCA’s Penalty Guidelines state the starting point for a breach of the careless riding rule is 5 riding days. We have taken into account Ms Spittles' admittance of the breach and that she has not breached this Rule in the previous 12 months. We also agree that the severity is at the low end. We have also reviewed the JCA’s list of penalties imposed under this Rule in the past 18 months on jockeys who only ride in the South Island to ensure, as best we can, a general consistency with those decisions.

The Committee believes the interference caused must be reflected in an appropriate penalty which we have decided is a period of suspension. From a starting point of 5 days we have reduced that by 1 day because of the admittance of the breach, a further day in recognition of Ms Spittles' excellent riding record (albeit from a very small number of rides in the past 12 months) and a further day in recognition that she is a South Island only rider.
