As Ms Morris had admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Ms Morris’s is suspended from the conclusion of racing 30 August 2018 up to and including 9 September 2018.

Facts:

Following the running of Race 8, (PLACEMAKERS ASHBURTON MAIDEN 1600), an Information was filed by Stipendiary Steward, Mr D Wadley, against Class A Rider, Ms J Morris, alleging careless riding in that she “… permitted her mount, ADVENTURESS, to shift outwards when not clear of BANNOCK (E Wright) which was checked near the 1200m.”

Rule 638(1)(d) reads as follows;

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”

Ms Morris, acknowledged that she understood the Rule and confirmed her admission of the breach.

Mr Wadley, had Mr McLaughlin demonstrate the incident by video using the front and side on views. He identified Ms Morris and her mount ADVENTURESS at the 1200m mark. He said at the time she moved across she was not sufficiently clear of BANNOCK which was checked.

Ms Morris having viewed the videos identified that the incident was self-explanatory. With reference to the impact she had on BANNOCK and Mr Wright, she specifically stated that: “I thought that I was clear. If you watch the video he wasn’t going forward or back”.

Submissions for Penalty:

Mr Wadley said that Ms Morris had an excellent record that she should be given credit for. He also submitted that the Stewards considered this breach to be at the low-level. He said the JCA Penalty Guide provided a starting point of a 6 National riding day suspension for a low range breach and submitted that the Stewards would be seeking a 6-day suspension.

Deferment was discussed with Ms Morris but she stated that she did not wish to seek a deferral of any period of suspension.

Reasons for Penalty:

The JCA Penalty Guide starting point for a low-range breach of this rule is a 6-day suspension. While Ms Morris may have felt justified in taking the action she did as there was no consistency on the part of Mr Wright to either go forward or fall back, he had the right to be in the position that he was in at the time. The onus was on Ms Morris to be the required distance clear before crossing, and on this occasion, she had failed to do that. As such we concur with the Stewards and determined that this breach fell at the low end, so therefore took the 6 day starting point. We didn’t see there being any aggravating factors that would warrant a penalty uplift.

The mitigating factor was Ms Morris’ admission of the breach and her good record.

After taking everything into account the Committee felt that an appropriate penalty was 5 days.
