Following the running of Race 9, the Coats Choice At Berkley Stud Maiden, an Information was filed by Stipendiary Steward Mr M. Williamson against Licensed Jockey Mr S. Lockie under Rule 638(1)(d) alleging careless riding.

The information reads as follows.

--

 

--

“I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 638(1)(d) in that S. Lockie rider of Our Saving Grace permitted his mount to shift in when not clear causing  Gypsy to check.  This happened about the 900mt mark.”

Rule 638(1)(d) reads as follows.

--

 

--

“(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be:

--

(a) …..

--

(b) …..

--

(c) …..

--

(d) careless…”

--

Mr Lockie had indicated on the Information that this breach of the Rules was admitted.  He also agreed that he understood the charge and the Rule it was brought under.

Facts:

--

Stipendiary Steward Mr McLaughlin gave evidence and used video coverage to show that with about 900 metres to run “Our Saving Grace” (13) was the widest of several runners when Mr Lockie allowed it to move inwards causing a check to “Gypsy” (4) which was racing inside it. It was conceded that there was a little outward movement from the inside, but that it was mainly the movement from Mr Lockie’s horse that caused the check to “Gypsy”.

Mr Lockie accepted the facts as presented by the Stipendiary Stewards.

--

Decision:

--

As this breach was admitted it was deemed to be proved in accordance with Rule 915(1)(d).

--

Submissions on Penalty:

--

In relation to penalty Mr Williamson advised that Mr Lockie had no previous convictions.  However the check to “Gypsy” was quite severe.  Mr Williamson submitted that a suspension of no less than 2 days would be appropriate in this case.

--

Mr Lockie made submissions that the incident looked worse than it was because of the pressure from the inside.

--

 

--

We adjourned to consider the matter of penalty.

--

Reasons and Penalty:

--

To Mr Lockie’s credit we took into account his admission of the breach and also his clear record.  However there was quite a severe check, even taking into account that there was a little movement from the inside.

--

We were satisfied that the penalty range suggested by Mr Williamson (no less than two days) was appropriate in this case, but that a suspension should be a little more than the minimum recommended.

--

 

--

On resuming the hearing we advised that a full written decision would be given later, and gave the following oral decision.

--

 

--

“Having heard the evidence relating to penalty we have taken into account that there was quite a bad check to “Gypsy” even having regard to the accepted contributory movement from the inside.

--

 

--

To Mr Lockie’s credit we have taken into account his admission of the breach and his clear record.  It is also relevant that Mr Lockie rides in the South Island only.

--

 

--

Taking all these matters into consideration we have decided that Mr Lockie will have his Jockey’s Licence suspended for three South Island days, from the completion of racing today, the 3 September 2010, until after the completion of racing on 18 September 2010.”
