Decision:

The Committee ruled that KING OF THE DANCE, had been prevented from taking an effective part in the race due to a mechanical failure of its starting stall. It was ordered that it be declared a non-starter.

Facts:

Following the running of Race 4, the Mainland Coachwork Ltd Rating 65, an information was filed by Stipendiary Steward, Mr D Wadley, requesting a ruling under Rule 632 as to whether KING OF THE DANCE, ridden by Mr D Prastiyou, received a fair start.

Mr P Corbett, trainer of KING OF THE DANCE, was present at the hearing of the information, as was jockey, Mr D Prastiyou.

Rule 632 (1) provides as follows:

If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Wadley showed head-on and side-on video replays of the start of the race, a 2200 metres event, with the assistance of Chief Stipendiary Steward, Mr J Oatham. He pointed out KING OF THE DANCE, ridden by Mr Prastiyou, drawn the number 1 gate in the 13-horse field. Mr Wadley submitted that the Stewards were seeking a ruling that KING OF THE DANCE, who finished in 7th place was denied a fair start. He showed the inside gate of KING OF THE DANCE open fully and then bounce back into the path of the horse, striking the gelding on the head. Mr Prastiyou stated that KING OF THE DANCE was affected by the gate bouncing back and striking the horse. He added that the gelding normally races handy and this incident clearly affected his chances over the early stages. Mr Prastiyou also said that his instructions were to race forward and due to the incident was left in a beyond mid field position over the early stages.

Reasons for Decision:

The Committee was satisfied that there had been a mechanical failure of the starting stall of KING OF THE DANCE, in that the inside gate failed to stay in the open position and bounced back striking the horse. Consequently, KING OF THE DANCE was slower than normal to begin and the Committee determined that KING OF THE DANCE was prevented from taking an effective part in the race, therefore denied a fair start.
