Facts:
Information No. 3243 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Apprentice Jockey (Class B), Mr J R Lowry, alleging that Mr Lowry “could not make the contract weight for DO UNO WHOIAM (Race 1), APACHE KID (Race 3) and NAVA (Race 8) and was replaced”.
Mr Lowry was present at the hearing of the information and he indicated that he admitted the breach. He was assisted at the hearing by Apprentice Jockey Mentor, Mr W Harnett.
Rule 330 provides as follows:
(3) A Rider shall not:
(c) fail to ride a horse at the weight which it is handicapped to carry.
Mr Davidson told the Committee that Mr Lowry had approached the Stewards prior to the meeting, as soon as he became aware that he was struggling to make the weight for all three of his rides at the meeting. The lightest weight at which he could ride would have been over 57 kilograms – well above his riding weight. Two of his mounts were carded to carry 56.5 kg (with Mr Lowry’s 2kg claim) and the third was carded to carry 54.5 kg with Mr Lowry’s claim. Mr Lowry had advised the connections of all three of his mounts, Mr Davidson said Mr Lowry had been stood down by the Stewards from all three of his mounts.
Mr Lowry said that he had been working very hard on his weight all week. He had got it down but losing the last of the weight had been very difficult, he said.
Submissions for Penalty:
Mr Davidson informed the Committee that Mr Lowry had been fined $100 on 16th April 2016 for a breach of the Rule and, on 13th August 2016, he was fined $200, both penalties being under the Minor Infringement system. This is Mr Lowry’s third breach of the Rule in recent months. Mr Lowry has been struggling with his weight, Mr Davidson said, and has been attempting to lose the weight, but it has got to the stage that the weight is not coming off.
Mr Davidson submitted that, for Mr Lowry’s own good, a term of suspension should be imposed. He submitted that the suspension should be for the next two South Island days.
Mr Lowry stated that a suspension would be more beneficial to him than a fine. During a break, he could “freshen” himself up and decide whether he wanted to continue riding, or do something different. He regretted that he had to keep letting people down, he said.
Mr Harnett said that Mr Lowry is very tall and struggles with his weight. He has done well to control it to this point. He was tired from constant wasting and needed a break. He had been very honest with everybody and had “fronted up”, Mr Harnett submitted.
Reasons for Penalty:
Based on the submissions of the parties, and taking into account Mr Lowry’s frankness and his record (this being his third breach in just over 4 months), the Committee determined that a term of suspension was required. We agreed with Mr Davidson’s submission that 2 days was an appropriate term. It is to be hoped that Mr Lowry can take full advantage of the short break and take the opportunity to address his obvious weight issues. A 2 day suspension will give Mr Lowry three weeks to do so before the next South Island meeting on 17th September.
