As Ms Williams has admitted the charge it is therefore deemed to be proved.

Penalty:

Ms Williams is suspended for 3 race days, commencing from the conclusion of racing on 29th December 2012 and ending at the conclusion of racing on 3rd January 2013. That period of suspension will encompass meetings at Kurow on 30th December 2012, Waikouaiti on 1st Janury 2013 and Omakau on 3rd January 2013.

Charge:

It was alleged that passing the 1300 metres K Williams ("Coup Darci Be") permitted her mount to shift inwards when not clear of "Dr Dee Bee" (S Wynne) resulting in that horse losing its rightful running.

Facts:

Shortly after the start of Race 4, Ms Williams riding "Coup Darci Be" was racing approximately 3 horse widths out from the rails in a forward position. "Dr Dee Bee" which had drawn 5 at the barrier had moved to a rails position, and was at that point leading the field. Ms Williams then permitted her horse to move inwards, when not her own length and another length clear, across the running line of "Dr Dee Bee". As a consequence, Ms Wynne, the rider of "Dr Dee Bee" had to take a firm hold of her mount to avoid clipping the heels of "Coup Darci Be". Mr Zarb told the hearing that when the Stipendiary Stewards spoke to Ms Wynne that she acknowledged that her horse was pulling hard and that she wanted Ms Williams to take the lead. However, Ms Williams came over her line and as a consequence she had to take a firm hold to avoid clipping heels.
 
Ms Williams told the hearing that her riding instructions were to "go forward". She knew that "Dr Dee Bee" was a noted front runner and that she intended to "sit outside". She said she heard Ms Wynne call out, but acknowledged that she did not give her enough room when crossing her line.

Submissions for Penalty:

Mr Zarb told the hearing that Ms Williams received a 3 day suspension on 29th November and had ridden in 12 races since that suspension. She was last suspended for a breach of Rule 638(1)(d) in April 2012 and was suspended for 3 days on that occasion. Mr Zarb further said that whilst the degree of interference to "Dr Dee Bee" was not significant, that in the opinion of the Stipendiary Stewards, the degree of carelessness was at the higher end of the scale. He submitted that a suspension of 3 days should be imposed.
 
Ms Williams did not take issue with a suspension being imposed. She said that she had made an error of judgement. She told us she had riding committments within the next 7 days and applied for a deferrment of the period of a suspension coming into effect.

Reasons for Penalty:

A suspension is the appropriate penalty in this case. We take as a starting point, a suspension of 5 race days, but also take into account aggravating and mitigating features in determining the final penalty. The degree of carelessness was reasonably high and that justifies and uplift of one race day, making our starting point a suspension of 6 days. Against that we take into account the mitigating features which we consider are, Ms Williams early admission of the breach, her candid approach in the hearing, her reasonable record , the fact that the effect of the breach on :Dr Dee Bee" was not significant and that she is a busy South Island rider. That enables us to afford a discount of 3 days on our starting point, making the suspension, 3 race days.
 
Ms Williams application for a deferrment of the coming into effect of penalty is granted.
