Decision:

Mr J Bates has been charged with a breach of Rule 1002 (1) (b) in that he acted in contravention of the Rule which requires all riders to wear an approved safety vest when riding in a race, or when riding track work, the Rule being encapsulated in the Regulations pursuant to the Rules of Racing.

THE FACTS

--

The fact situation is quite simple.  Stipendiary Steward Mr Stewart Ching was at the Rangiora Racecourse on Wednesday 15th October 2008 in the company of Mr Robin Scott, the Racecourse Inspector, where he observed two riders namely Mr Bates and one other, working horses without wearing an approved safety vest.  He challenged each rider in this regard, and both conceded that they were not wearing the safety vests.

Mr Bates has admitted the charge which is therefore deemed to be proved.  He has indicated on the Information that he does not wish to be present at the hearing.

PENALTY

--

The appropriate penalty for this charge is a fine.  There are no aggravating features in relation to this matter and we therefore, in terms of consistency of penalties imposed in similar cases, impose a fine of $300.
