Decision:

The Committee ruled that horses BIDDEDO (8) and DOUBLE STAR (11) had been prevented from taking an effective part in the race due to a mechanical failure of its starting stall. It was ordered that they be declared non-runners.

It was further ordered that dividends for the race be amended accordingly. 

Facts:

Following the running of Race 2, the Continuous Accounting Rating 75, an information was filed by Co-Chief Stipendiary Steward, Mr R Neal, requesting a Ruling under Rule 632 as to whether DOUBLE BLUE, ridden by M Haruki and BIDDEDO, ridden by C Barnes, should be declared non-runners due to them both being denied fair starts.

Rule 632 provides as follows:

If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter. 

Submissions for Decision:

Mr Neal showed back straight head on video replays of the start of the race, a 1200 metres event. He pointed out BIDDEDO, ridden by Mr Haruki, drawn the number 5 gate and DOUBLE BLUE, ridden by Miss Barnes, drawn 6, in the 11-horse field. He pointed out the gates of BIDDEDO and DOUBLE BLUE remained closed when all other gates were seen to be open, when the start was declared. Mr Neal stated it was clear on the films that the gates on both stalls were very slow to open and denied both horses a fair start. Mr Neal submitted that the Stewards were seeking a ruling that BIDDEDO and DOUBLE BLUE be declared non-runners.

Mr Hughes and Mr Stackhouse both said that it was clear on the films that the gates had not opened correctly and that both horses had been denied fair starts. Miss Barnes and Mr Haruki also agreed that the gates had not opened correctly.

Reasons for Decision:

The Committee was satisfied that there had been a mechanical failure of the starting stalls of BIDDEDO and DOUBLE STAR, in that they failed to open simultaneously with the other stalls. As a consequence, BIDDEDO and DOUBLE STAR were both very slow to begin, losing considerable ground which prevented them from taking an effective part in the event.
