The Committee were satisfied that the track was in an unsafe condition and therefore ruled that the day’s racings be postponed.

Facts:

Following the running of Race 1, the Gluyas Motor Group Rating 65, an Information for a Request for a Ruling was filed by Stipendiary Steward, Mr J McLaughlin, to determine whether racing should continue after a track inspection from concerned parties to which the Stewards believed the track to be unsafe for racing to continue.

Rule 902 (2)(a)(ii) reads as follows:

902 (2) The functions of a Judicial Committee shall be:

(a) from the commencement of the first proceeding which it commences to deal with on any day of a Race Meeting or one hour prior to the starting time of the first Race of that day until after the conclusion of the last proceeding which it commences to deal with on that day, or thirty minutes after the last Race run on that day (whichever is the later) to:

(ii) determine any question as to whether that day of racing or any part thereof should be postponed, abandoned or cancelled;

Mr McLaughlin gave evidence that following the running of the 1st race several riders made comment to Stipendiary Steward Mr S Renault, at the weigh in, that their mounts had slipped during the running particularly near the 800m and over the crossing. After talking to all riders it was determined that the majority wished to continue riding but it was also agreed that a track inspection be carried out. A delegation of riders, Stewards, trainers’ representative and Club representatives inspected the track between the 700m and 900m. Mr McLaughlin stated that during the inspection it was very apparent that there was movement and quite considerable movement varying from sideways movement near the 900m as well as near the 700m. In addition he said that there was a lot of small movement in this area as is consistent when you get a hard track with light rain on the surface. Mr McLaughlin stated that in his opinion the track was in an unsafe condition to continue racing and submitted that the days racing be postponed.

Mr Walsh stated that he himself had led up during the race and had no issues with his horse moving but was conscious that he was riding a sure footed horse. He was aware that there were issues with the track on pulling up as quite a few riders stated that they had moved during the running. The inspection of the track revealed that it was very obvious that there was a lot of movement ranging from 3-6 inches to half-moon marks.

Mr Cameron agreed with Mr Walsh in his assessment of the track. He said he slipped over the crossing which he believed was not set up quite right and created an issue due to the state of the track. He said he felt his horse move during the running when racing on the outer but not near the 800m. He said he was fortunate that his horse raced kindly and he was able to keep it balanced up and in conjunction with a slow pace was able to look after himself during the running. He said it was obvious that there were issues with the track due to all the movement marks left.

Miss Morris said she was racing 3 wide and her horse had moved on several occasions on the bend near the 800m. She said most riders were conscious of the track moving and were giving each other plenty of room.

Mr Coulbeck said that there was definitely sideways movement and in his opinion there would not be a trainer that would expect a jockey to ride on a track in that condition. He said that the weather had played a part in the condition of the track with warm north west winds the day before drying out the track and drizzle on the morning of the races creating the problem.

Mr Jones stated that safety was paramount and believed that a postponement would be advisable. The club, he said, would apply to race on Monday with the remainder of the races.

Reasons for Decision:

The Committee carefully considered all evidence and submissions. The Committee also had the advantage of inspecting the track at the Stipendiary Stewards' request and agree with the assessment of Mr McLaughlin, the riders and trainers representatives. There was clear evidence on the track from the 700m to the 900m that horses were slipping in varying degrees and that the track was not in a safe condition to continue racing.
