Charge:
Following the running of Race 1, an information was filed by Stipendiary Steward J McLaughlin, alleging a breach of Rule 638(3)(b) against Licensed Jockey CW Johnson as the rider of "Zazzadad", in that he struck his mount an excessive amount of times between the 500 metres and 200 metres.
Rule 638(3)(b) reads:
" A rider shall not: ...(b) strike a horse in a manner which, or to an extent which is unnecessary, excessive or improper."
In this case the allegation was "excessive".
Facts:
Mr McLaughlin invited Mr M Davidson, Stipendiary Steward to demonstrate to the hearing, Mr Johnson's whip actions betweeen the 500 & 200 mark. Over that distance, Mr Davidson said, by reference to the video coverage, that Mr Johnson had struck his mount at least 12 times without at any time returning his whip hand to the reins as required by the guidelines. Mr Davidson said that his estimate of the number of times that Mr Johnson struck his mount was "generous in favour of Mr Johnson".
Mr Johnson stated in reply, that he accepted that his use of the whip was excessive, although he didn't realise that he had hit his horse that many times. He also said that the horse was "on its last chance" as it was a bit lazy.
Submissions for Penalty:
Mr McLaughlin told the hearing that Mr Johnson has held a Jockey's licence for 29 years and that this was the first time in his riding career that he has been charged with using his whip excessively. He submitted that having regard to Mr Johnson's good record in this regard that a fine in the regiion of $100 to $200 was appropriate.
Mr Johnson did not have any submissions on the question of penalty.
Reasons for Penalty:
We agree that Mr Johnson's record speaks for itself. Mr Johnson is given credit for his very good record and for his early admission of the charge.
