Hearing of information number 5107 filed under Rule 871(1)(d) by Mr N Goodwin, Stipendiary Steward, (Informant) alleging that Mr JL Waddell (Licensed Jockey) allowed his mount "Band of Colours" to move outwards when not sufficiently clear with approximately 300 meters to run
Following the running of Race 10, Mr JL Waddell was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.
--THE FACTS
--With approximately 300 metres to run, Mr Waddell, the rider of "Band of Colours" allowed his mount to move outwards when not sufficient clear, bumping "Cupriella Rose" (Ms K Williams). The video coverage of the film showed Mr Waddell in a position where he was looking for racing room. "Cupriella Rose" was on his outside. Mr Waddell moved his mount outwards, bumping "Cupriella Rose" and knocking it off stride. "Cupriella Rose" did not finish a stake bearing position. Mr Waddell's mount won the race.
--Mr Waddell pleaded guilty to the charge. He said that he was looking for room and that he "angled out" too far. He said that his mount is a big horse which was full of running, but he acknowledged that it was his movement outwards which caused him to come into contact with "Cupriella Rose".
--PENALTY
--On the question of penalty, Mr N Goodwin, Stipendiary Steward, told the hearing that he did not consider that the carelessness was at the higher end of the scale. He thought that it could perhaps be described as over competitive riding. He drew the committee's attention to the fact that Mr Waddell has had two periods of suspension of three days each in the last three months.
--We are inclined to the view that the incident was "over competitive riding" on the part of Mr Waddell, but the fact of the matter remains that "Cupriella Rose" was on a line that it was entitled to maintain. Any chances that "Cupriella Rose" had of finishing in a stake bearing position were eliminated by Mr Waddell's actions. Whilst a jockey is expected to ride in a competitive fashion to ensure that he finishes in the best possible position, the fact of the matter is that a jockey may not "make his own way" by taking other horses "out of the race" in the fashion that Mr Waddell did. Such actions compromise horse and rider safety.
--Notwithstanding that the carelessness was not at the higher end of the scale, having regard to Mr Waddell's riding record, the only way in which this matter can be dealt with is by way of suspension. Credit is given for Mr Waddell's early guilty plea and his candid admissions in the judicial hearing.
--DECISION
--Thus, whilst it may have been appropriate to impose a period of suspension longer than which Mr Waddell has been subjected to, having regard to the mitigating factors that have been mentioned we are able to set the suspension period again, at the equivalent of three days.
--Thus, Mr Waddell having informed us that he would have been riding on 22nd, 24th and 25th March, we therefore suspend Mr Waddell for a period of one week, that is to say from the conclusion of racing on Saturday 18th March 2006 until the conclusion of racing on Saturday 25th March 2006.
