"Petranova" is declared to be a non-starter.
Facts:
When the starting gates opened at the beginning of Race 10 at the Ashburton Racing Club's meeting on Sunday 16th October 2011, the gate to barrier position 9, did not open simultaneously with the remainder of the gates. There was a delay of appoximately one half of a second, and as a consequence "Petranova' was slow away by two to three horse lengths. The incident was clearly able to be seen from a head on view of the starting gates.
"Petranova" was 5th past the post.
Submissions for Decision:
Mr Ray submitted that the slow opening of the gate to barrier position 9, was a mechanical failure in terms of Rule 632.
He therefore submitted that as "Petranova" had not finished in the first three placings, that it should be declared a non-starter as its chances had been materially prejudiced.
Reasons for Decision:
In terms of Rule 632, as the gate to barrier postion 9 did not open in conjunction with the other gates, we find that there was a mechanical failure which prevented "Petranova" from taking an effective part in the race. The chances of the horse were materially prejudiced.
