Facts:
Following the running of the 10th race at the Ashburton Racing Club's meeting on Sunday 16th October 2011, Ms K Williams the rider of "And She Was" (4th placed horse) lodged a protest against Ms L Allpress "Mr Thorpedo" (3rd placed horse) alleging that interference had occurred which affected the chances of "And She Was" . The official margin between 3rd and 4th was a nose.
Mrs J Hay, the trainer of "And She Was" (Ms K Williams), elected to present the protest on behalf of the informant. She used the video coverage from the head on camera to demonstrate the incident which gave rise to the protest. With approximately 200 metres to the finishing post, "And She Was " was racing in the clear up on the hindquarters of "Mr Thorpedo". At that point "Mr Thorpedo" made an outward movement of about three quarters of a metre across the line of "And She Was". The movement, Mrs Hay said, was clearly visible by reference to mowing strips on the track. She said that as a result, "And She Was" was unbalanced and that it took Ms Williams some time to balance the horse and to then continue on to the line. The margin was only that of a nose and Mrs Hay submitted that had it not been for the actions of "Mr Thorpedo" that "And She Was" would have beaten "Mr Thorpedo". She alleged that Ms Williams was deprived of a gap for clear racing room to the post by virtue of the interference.
In response to a question from the Chairman, Ms Williams confirmed that she had "to stop riding" in order to balance her mount. We asked for the side on camera view to to be shown, and Ms Williams pointed out what she had alleged on the video coverage.
Ms Allpress then responded on behalf of the connections of "Mr Thorpedo". She alleged that she had little or no influence on the incident, and pointed to the actions of "Santos" (L Robinson) which horse finished second. She asked the Committee to observe how "Santos" made quite a severe inwards movement and caused interference to both herself but primarily to "And She Was". Ms Allpress wondered why Ms Williams had brought the protest against her.
In response, Mrs Hay said that the movement of "Santos" happened after the interference caused by "Mr Thorpedo", and thus had no relevance to the protest.
Submissions for Decision:
The informant's submission was that had it not been for the interference caused by "Mr Thorpedo" to "And She Was" and having regard to the narrow margin of a nose, that"And She Was" would have finished ahead of "Mr Thorpedo".
The respondent's case was that the interference was caused by "Santos".
Mr AL Ray, Stipendiary Steward, was invited to give his views on the incident. He said that there was outward movement by "Mr Thorpedo" and that the inward movement of "Santos" did perhaps contribute to the incident. He did, however, observe that the margin between 3rd and 4th was only a nose.
Reasons for Decision:
The essence of the protest was that interference was caused to "And She Was" by the outwards movement of Ms Allpress" mount. The video evidence revealed that "Mr Thorpedo" moved outward at approximately the 200 metre mark by some three quarters of a metre on to the racing line of "And She Was". That movement was easily seen by reference to the mowing strips on the track. Ms Williams had to "stop riding" at that point and to balance her mount. This in turn meant that she had to pause to compete for the gap that became available.
e did observe that "Santos" moved sharply inwards and may have caused some interference to the 3rd and 4th placed runners, but in our view, that happened after the interference to "And She Was" by "Mr Thorpedo". There was no protest aginst "Santos". Our focus was therefore on the interference caused by "Mr Thorpedo" to "And She Was". We find as a fact that interference occurred.
Ms Williams' mount, we find, lost momentum at the point that the interference occurred. The margin was a nose. The loss of momentum at that point was at a critical stage, and as a result we were of the opinion that "And She Was" would have finished ahead of Mr "Thorpedo".
