--At the race meeting held on Friday 16 March 2007 by the Ashburton Racing Club an Information no. 7341 was lodged by the Stipendiary Stewards alleging a breach of Rule 828 (1) (2) against the Defendant.
----The information alleged that C Johnson, the representative of the trainer of Pushy Too scratched the horse from race 7 at 8.09 a.m. on race day when the required scratching time was 7.30 a.m. on that day. It was noted by the Committee that no horse was denied a start in the race due to the late scratching.
----The information recorded that Mr S Woodford, the official trainer of Pushy Too, had left the horse in Mr Johnson's care.
----At the outset of the hearing the Committee noted that Mr Johnson admitted the breach and did not wish to be heard. The Stipendiary Stewards on the information had recommended a fine of $100.00 and Mr Johnson, in writing, had accepted that as the appropriate penalty.
----Accordingly the charge is formally found proven and a fine of $100.00 imposed.
