As Miss Wynne has admitted the charge it is therefore deemed to be proved.
Penalty:
Miss Wynne is suspended for two riding days. She does not apply for a deferment. Her period of suspension therefore encompasses meetings at Invercargill (Winton) on 17th May and Gore on 21st May 2013.
Charge:
It was alleged that Miss Wynne shifted her mount inwards when not clear of "Chapelle D'or" (R Doherty) with 1,000m to run. This resulted in "Chapelle D'or" having to be restrained and losing its position.
Facts:
As the field approached the 1,000 metres mark in the "Barneswood Farm Maiden", Miss Wynne riding "Rockahoy" racing in a three wide position allowed her mount to gradually shift inwards at a point when she wasn't entitled to do so, as she took the line of "Chapelle D'or" in the process. Mr Doherty had to restrain his mount as a consequence and lost the running line that he had.
Miss Wynne candidly admitted that she was not quite far enough ahead when she moved in on Mr Doherty's line but having done so her horse being full of running soon moved clear. It was clear that she was remorseful for her actions.
Submissions for Penalty:
Mr Zarb said that Miss Wynne had been co-operative with the Stipendiary Stewards and had admitted the charge at the earliest opportunity. She has had 127 career rides and has only been charged once with careless riding. Mr Zarb submitted that a three day suspension, "at the most" should be imposed. He said that her carelessness was at the "very lowest" end of the scale.
Miss Wynne did not have submissions to make on the question of penalty.

I commenced my consideration of penalty by taking a starting point of a 5 day suspension. There were no aggravating features which warrant an uplift on my starting point. After taking into account the mitigating features referred to above, and in particular the slight degree of carelessness, in this case I allow a generous discount of three days on my starting point.
