DECISION AND REASONS:
--Following the running of Race 7 Mr Shane Marr the trainer of Sir Ambrose (6) laid an information instigating a protest under Rule 876(1).
----The information reads as follows.
------"I allege that Cent A Misse or its rider placed 3rd by the judge interfered with the chances of Sir Ambrose placed 4th by the judge. The interference occurred over the concluding stages.
--Rule 876(1) reads as follows.
--"If, in the opinion of the Judicial Committee, a horse placed by the Judge or its rider has interfered with the chances of any other horse or horses placed by the Judge then, subject to sub-rule 2 hereof, the Judicial Committee may place such first-mentioned horse immediately after the horse or horses so interfered with.
--Sub-rule 2 did not apply in this case.
----Mr Marr was accompanied by the rider of Sir Ambrose, Mr B. Hibberd. Mr Kennedy was accompanied by the rider of Cent A Miss, Miss A Chesmar. All these persons gave evidence. A call had been made for the owners of the two horses to attend the hearing but none attended.
--Mr Hibberd gave evidence and illustrated what had happened by the use of video coverage of the race. He said that Cent A Miss had pushed his horse about three horse widths wider on the track over the concluding stages of the race. He also said that this interference had affected his horse's chances. In particular Mr Hibberd said that when his horse was pushed wider on the track he had to stop riding it for a short time, and this caused him to lose his momentum, and that he had lost at least half a length. When he regained his momentum he was able to close on Cent A Miss quite quickly.
--Mr Marr gave supporting evidence.
--The official margin between 3rd and 4th was a short neck.
--Mr Kennedy gave evidence and he disputed that Mr Hibberd had to stop riding his horse during the incident, and that he believed that the interference was insufficient to justify a change in placings.
--Stipendiary Steward Mr Ching had been present throughout the hearing and in accordance with the Rules he was asked if he wished to give evidence and call witnesses. Mr Ching then gave evidence and said that Cent A Miss had inconvenienced Sir Ambrose when that horse rolled out under pressure and took Sir Ambroses's line. Mr Ching said that he would leave it to the Committee to decide if there should be a change in the placings.
--After the completion of the evidence we took time to consider our decision.
--The video of the race showed that Cent A Miss had rolled out about 3 horse widths when under pressure close to the finish of the race. We were satisfied that Mr Hibberd did have to stop riding his horse for a stride or two because of this interference and that he did lose some momentum. We were also satisfied that it was of particular importance that the margin between 3rd and 4th at the finish of the race was a rapidly diminishing short neck.
--Before a protest can be upheld the Committee must first find that there has been interference. In this case we are satisfied that there was interference. Secondly we must decide if the interference affected the chances of Sir Ambrose. We are also satisfied the interference did affect the chances of Sir Ambrose. In coming to the decision as to whether or not we should exercise out discretion to relegate because of the interference we took into account that the interference, although not severe, took place at a crucial stage of the race. We also took into account the margin between the two horses at the finish of the race.
--As a result of these deliberations we decided to exercise our discretion to relegate Cent A Miss to fourth place.
--On our return to the Enquiry Room we gave the following oral decision.
--"We find that there was interference over the concluding stages of the race. We also find that the chances of Sir Ambrose were affected. We have a discretion whether to relegate or not. We must be satisfied that Sir Ambrose would have beaten Cent A Miss for third place but for the interference. Having seen the video coverage, and having heard the evidence, we are satisfied that, but for the interference, Sir Ambrose would have finished third. The protest is upheld.
--The amended places are as follows.
