Following the running of Race 7 an Information was laid by Stipendiary Steward Mrs Williams alleging a breach of Rule 869(3)(b). The allegation was that Mr De Fillipi drove carelessly
| -- DECISION AND REASONS: --Following the running of Race 7 an Information was laid by Stipendiary Steward Mrs Williams alleging a breach of Rule 869(3)(b). The allegation was that Mr De Fillipi drove carelessly in the run to the finish by moving outwards and causing interference to Satan's Highway. --Mr De Fillipi was present at the hearing and he confirmed that he admitted this breach of the Rules. There was also an agreement by the parties that the evidence given at the hearing of the protest would be taken as read and used as a basis for this hearing. --Penalty: Mrs Williams advised that Mr De Fillipi had a good driving record and that in this case he had been co-operative and honest in accepting that there had been interference. Taking these matters into account, and Mr De Fillipi's guilty plea a fine in the vicinity of $200-00 to $250-00 was recommended. --In considering an appropriate penalty I agree with Mrs Williams that Mr De Fillipi was quite honest in quickly agreeing that he had caused some interference. I also take into account Mr De Fillipi's good driving record, his guilty plea, and that the interference was relatively minor. Mr De Fillipi will be fined the sum of $200-00. --
