DECISION AND REASONS:

Following the running of Race 4, the Avon City Ford (Rangiora Service Centre) Mobile Pace, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr D. J. Butt, the driver of “Song For The Asking” (14), alleging a breach of Rule 507A.  The charge reads as follows.

“I the above named informant allege that the above named Defendant committed a breach of Rule 507A in that Driver D. J. Butt (Song For The Asking) failed to take his drive by the required time delaying the start, finally taking the drive in the birdcage with 2½ minutes before race start time.”

--

Rule 507A reads as follows.

--

“Every horseman shall be available to take their engagement to drive
a horse at least fifteen minutes prior to the race start time, except when  
otherwise directed by a Stipendiary Steward.”

--

Mr Butt had indicated on Information that he admitted this breach of the Rules, and also that he did not wish to attend the hearing.  In an explanation for this breach Mr Butt had told the Stipendiary Stewards that he “forgot”.

--

Mr Escott advised that Mr Butt had no previous relevant convictions and recommended a fine of $200-00, as the breach was relatively serious. 

--

We were satisfied that this breach was relatively serious and that a fine of
$200-00 was appropriate in this case.  Accordingly Mr Butt was fined the sum of $200-00.
