The protest is upheld and SPICY GIRL BECQUI was relegated from 2nd to 3rd placing.

Consequent upon relegation, the amended placings for the race are follows:

1st – 1 Quite Ideal
2nd – 12 Glengarry Knight
3rd – 13 Spicy Girl Becqui
4th – 4 Johnny White
5th – 14 Three Ideas
6th – 11 Rock n Joy

It was ordered that dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of Race 8, (Canterbury Trotting Owners Association Mobile Pace 2000m), Information A10814, instigating a protest was filed by Stipendiary Steward, Mr Wallis against SPICY GIRL BECQUI (R T May), placed second by the judge, on the ground that it “broke prior to and over the finish line and was lapped on” by GLENGARRY KNIGHT (G D O’Reilly) placed second by the judge.

Mr Hope trainer of Spicy Girl Becqui was present at the hearing.

Rule 870 provides as follows:

(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such or horsemen then (subject to Rule 869 (8) such regulation of the horse shall be at the discretion of the Judicial Committee.

The judge’s official placings were as follows:

4th – 4 Johnny White
5th – 14 Three Ideas
6th - 11 Rock n Joy

The official margin between 2nd and 3rd was ¾ length.

Submissions for Decision:

Mr Wallis showed the replay of the final 30 metres of the race. He pointed out SPICY GIRL BECQUI, and said she was travelling rough. He said that 2 strides before the line SPICY GIRL BECQUI is in a gallop. Mr Wallis said that although SPICY GIRL BECQUI was pacing rough before the finish line it was in its correct gait but 2 strides before the line the horse went into a gallop across the finishing line, finishing in 2nd place. It was lapped on by the third runner, GLENGARRY KNIGHT.

Mr Hope said that he agreed that the horse was not pacing perfectly but that it was still pacing over the line.

Mr Renault produced the official photo finish of the race.

Reasons for Decision:

The committee was satisfied that SPICY GIRL BECQUI was in its correct gait until 2 strides from the finishing line. At that point SPICY GIRL BECQUI was in a gallop across the finishing line and that it was lapped on by 3rd placed runner GLENGARRY KNIGHT. The official margin between 2nd and 3rd was ¾ of a length. The official photo finish clearly shows SPICY GIRL BECQUI in a gallop across the finish line.
