DECISION AND REASONS:

--

Following the running of Race 3, Flair Fillies & Mares Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr R B Ward, alleging that Mr Ward, as the driver of AFTER MIDNIGHT in the race, drove carelessly in that he 'shifted out resulting in checks to JAYDEN?S LADY (J F Curtin) and SCHERGER REIN (R D Holmes) with approximately 200 metres to run?.

Mr Ward was present at the hearing of the information and admitted the breach.

The charge was found to be proved.

Mr Escott sought leave of the Committee to rely on the evidence adduced at the earlier protest hearing in support of the charge. He informed the Committee that Mr Ward had a clear record over the past 12 months. He recommended a suspension up to and including 27 April next, taking into account Mr Ward's guilty plea. Mr Escott pointed out that the favourite had been checked out of the race. He submitted that the careless driving was ?middle of the range to just below middle of the range?.

Mr Ward stated that he normally used other drivers on his horses but he had found it difficult to obtain their services from time to time, in which case he drove them himself. He had been hoping to be able to drive horses trained by him over the next 2-3 weeks, if other drivers were not available. Mr Ward informed the Committee that he had not had a suspension previously in ?twenty-odd? years as a driver. He acknowledged that he does not drive a lot.

The Committee took into account the submissions of the parties and, in particular, Mr Ward's previous unblemished record and his admission of the breach. An aggravating factor was, as submitted by Mr Escott, that the favourite's chances had been affected and, further, that Mr Ward's driving had resulted in a relegation. Taking all matters into account, the Committee suspended Mr Ward's driver's licence for a period up to and including 21 April 2006.
