DECISION AND REASONS:
--Following the running of Race 4, The Southern Trust Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr C T Woodward jnr, alleging a breach of Rule 869 (2) (a) in that Mr Woodward, as the driver of RUSHIN COURAGE in the Race, used his whip excessively in the run home.

Mr Woodward had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

The Committee was showed a video replay of the final 300-400 metres of the Race. Mr Escott alleged that Mr Woodward used the whip on RUSHIN COURAGE on some 30 occasions in the 400 metres from the home turn which, he said, was excessive.

Mr Escott asked the Committee to take into account Mr Woodward’s admission of the charge. Mr Woodward had not breached the Rule within the previous 12 months, Mr Escott said. He recommended a fine of $200.

Mr Woodward was fined the sum of $200 having regard to the matters put forward by Mr Escott.
