DECISION AND REASONS:
--Stipendiary Steward Mr N. G. McIntyre filed an Information against Junior Horsewoman Miss M. R. McIntyre alleging a breach of Rule 869(2)(a). It was alleged that Miss McIntyre had used her whip excessively in the run home.
--Miss McIntyre had indicated on the information that she admitted this breach of the Rules, and that she did not wish to attend the hearing. Mr McIntyre said that during the preliminary hearing Miss McIntyre had been assisted by Open Horseman Mr M. P. Jones.
--Video coverage of this incident was used to show that Miss McIntyre had used her whip on about 28 occasions in the run home.
--In relation to penalty Mr McIntyre advised that Miss McIntyre had no previous relevant convictions, and recommended a fine of $200-00.
--We were satisfied that the amount of the fine recommended was appropriate. Accordingly Miss McIntyre was fined the sum of $200-00.
