Following the running of Race 10, The Southern Trust Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, alleging that Mr De Filippi "dropped his leg for approximately 100 metres in the run home on FALCON?S FIRE".

Mr De Filippi had signed the Statement of Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found to be proved.

A video replay of the final stages of the race was shown to the Committee which clearly showed Mr De Filippi's left foot out of the sulky rest for a considerable distance, as alleged in the information.

Mr De Filippi was fined the sum of $100.
