FACTS

Mr Elliot, the declared Rider for “EXPRESS DESIRE” failed to make the carded weight of 56.5kg and was replaced.

Mr Elliot admitted the breach.

DECISION

The Charge was found proved.

PENALTY SUBMISSIONS

Mr Elliot’s record showed two prior breaches of the Rule:

23 April 2022            –           Fined $300

19 March 2022         –           Fined $300

Mr Elliot said that due to the cooler weather he was having difficulty controlling his weight.

REASONS FOR PENALTY

As this was Mr Elliot’s third breach in 120 Days, an increase on the previous fines was deemed appropriate.

 PENALTY

Mr Elliot was fined $400.
