Following the running of Race 6, Durham Ogilvie-HANZ Life Member Premier Maiden, an information requesting a ruling was filed by Stipendiary Steward, Mr S C Ching, on the following matter:
--“In that rider, D G Bradley (RHYTHM MASTER) weighed in 0.7 of a kilogram under the weight it weighed out and that the horse should be disqualified”.

DECISION AND REASONS:
--Following the running of Race 6, Durham Ogilvie-HANZ Life Member Premier Maiden, an information requesting a ruling was filed by Stipendiary Steward, Mr S C Ching, on the following matter:
--“In that rider, D G Bradley (RHYTHM MASTER) weighed in 0.7 of a kilogram under the weight it weighed out and that the horse should be disqualified”.

RHYTHM MASTER had finished in 2nd placing in the Race.

Rule 857 (3) provides as follows:
--If, on being weighed in, a rider cannot draw the proper weight, (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn the horse shall be disqualified for the race”.

Mr Bradley was present at the hearing of the information. He acknowledged that he had weighed in 0.7 kg under the correct weight (58 kg). He stated that there was no gear or lead missing which would explain the situation. Mr Ching confirmed that the trainer of the horse, Mr M R Pitman, had been present earlier and accepted the weight discrepancy and that RHYTHM KING had to be disqualified under the Rules.

The Committee was satisfied as to the facts and that Mr Bradley had weighed in 0.7 kg under the correct weight and, therefore, Rule 857 (3) as set out above applied. Under the Rule, the Committee had no discretion but was required to disqualify RHYTHM KING from the Race and the Committee ruled accordingly.

Consequent upon the disqualification, the amended result for the Race is as follows:
