Decision:

Following Race 9 an Information was filed pursuant to Rule 871 (1) (d).  The Informant, Mr R Sanders alleged that Miss Hercock permitted her mount SMART CHIEF to shift inwards near the 1900 metres when not sufficiently clear of THE GROGOCH (V Coleman) who was checked and forced inwards resulting in XAN XAN (L Innes) and DON ROSSININ (S Collett) being tightened and checked.

Miss Hercock admitted the breach.

Mt Oatham demonstrated the video films which clearly showed Miss Hercock shifting in and causing crowding to THE GROGOCH, when no more than a length clear of that runner.  This occurred near the 1900 metres.

PENALTY SUBMISSIONS

Miss Hercock said she had rides at Trentham on 14 March 09 and did have commitments to ride at Invercargill on 15 March 09.

Mr Sanders said Miss Hercock had an excellent record with no suspensions in the last 12 months.  He asked the Committee to consider the checks to 2 runners and the race was for $40,000 on a premier day.  He submitted 5 – 7 days would be appropriate.

The Committee carefully considered all submissions and before imposing an appropriate penalty took into account the following:

-  Her guilty plea

--

-  Level of carelessness which we do not consider high

--

-  The interference caused to 2 runners

--

-  Premier day and the $40,000 stake

--

 

--

Accordingly we impose a suspension to start after racing on 14 March and conclude after racing on 21 March 2009 (5 days).
