DECISION AND REASONS:

--

Following the running of Race 8, the Paul Renwick ? Celebrating 30 Years In Business Handicap Pace, an information instigating a protest was laid by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8). The information reads as follows.

"This is a protest by horse number (5) placed 5th by the judge against horse number (9) placed 4th by the judge on the grounds of interference in the run home."

Rule 869(8) reads as follows.

--

"The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

--
    ------
      --
    1. may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
    2. --
    3. may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
------

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby."

Present at the hearing were Mr S. D. Lethaby who was the driver, Mr I. R. Court the owner/trainer of "Regal Lustre", and Mr B. N. Orange who was the driver of "Jays Debut".

Stipendiary Steward Mrs K. Williams showed video coverage of the concluding stages of the race showing Regal Lustre running outwards abruptly when looking for racing room taking the line of Jays Debut and causing this horse to break. Mr Orange gave evidence that Jays Debut was "bombed" by Regal Lustre which caused his horse to break and lose all chance.

At this stage Mr Court told the Committee that he did not contest the protest. Therefore the protest was upheld.
