An information was lodged alleging a breach of Rule 871 (1) (d) by Miss C Anderson, rider of LUCRATIVE in that she allowed her mount to shift ground inwards when not clear causing a check to MUNRO, ridden by J Laking near the 800 m mark.
--Stipendiary Steward Mr S Ching used video film to highlight the incident in question. The film clearly showed Miss Anderson, on LUCRATIVE, galloping approximately 3 wide towards the rear of the field, near the 800m mark. Miss Anderson, after looking twice to her left, then moved inwards, thereby taking the running position of MUNRO, ridden by J Laking, causing MUNRO to be checked back.
--Miss Anderson confirmed this observation, adding that the horse was an awkward ride and had moved in more sharply than planned.
----
SUBMISSIONS ON PENALTY :
--Mr Davidson presented Miss Anderson’s recent riding record which showed one suspension on 26 December 2008, otherwise a clean record. Mr Davidson suggested a mid-range penalty of 4 – 5 days, asking the JCA panel to consider previous record and guilty plea.
--The Committee adjourned to consider penalty.
----
DECISION / REASONS :
--The Committee decided to suspend Miss Anderson for 3 riding days, suspension to commence from Sunday 22 February 2009 until Friday 06 March. The Committee took the following matters into account in reaching this decision.
--1. 7 day Rule allowing Miss Anderson to fulfil riding commitments at Christchurch on Saturday 21 February.
--2. Guilty plea.
--3. Racing manners of the horse.
--4. Miss Anderson’s riding record (1 suspension 26 December 2008).
