| -- DECISION AND REASONS: --The Information alleges that Mr W Screen, the driver of EYES WIDE OPEN failed to have both feet in the foot rests over the concluding stages. --Mr Screen admitted the breach and was present at the hearing. --Mr Screen took the rule as read. A film of the alleged incident was shown and this clearly showed Mr Screen to have one foot out of the footrest over the concluding stages. --It was confirmed that Mr Screen had no record of being charged under this ruled, namely 867. --When arriving at a penalty Mr Screen's admission of the breach and his good record were taken into account and a monetary penalty of $100 was imposed. --The Stipendiary Stewards had no objections to a monetary penalty in this instance. |
