A telephone conference was held this morning between the Chairman of the Judicial Committee, counsel for the informant, Mr Simon Moore and Mr Brian Dickey, and counsel for the defendant, Mr Barry Hart and Mr Antony Shaw, following a request for an adjournment from Mr Shaw in a letter to the Chairman of the Judicial Committee dated 27 May 2005.
----Mr Hart spoke to Mr Shaw's letter and confirmed counsel for the defendant's request for the matter to be adjourned. He indicated that the defence was not in a position to proceed on 1 June as there had not been adequate time to brief its expert witnesses in relation to the scientific evidence to be relied on by the informant, or to prepare a full answer to the charges. In addition, there were still outstanding matters relating to disclosure. Mr Moore did not as a matter of principle oppose the adjournment but emphasised the importance of the hearing to the integrity of the racing industry and requested that the charges be set down for hearing at the earliest possible opportunity. Counsel for the defendant requested that a hearing date not be set until matters relating to disclosure had been resolved. Mr Moore opposed this, asking for a definite date. Both parties agreed that a full week would need to be set aside for the hearing.
----The Chairman indicated that he wished the matter to be heard before the end of the current racing season and he required counsel to agree to a definite date. After discussion between the parties it was evident that a date in June or July was not acceptable to counsel because of other commitments. The earliest possible date was 3 August.
----The hearing of the charge against the above-named defendant, set down for hearing by a Judicial Committee of the Judicial Control Authority at Waikato Racing Club, Te Rapa Racecourse, Hamilton on 1 June 2005, was accordingly adjourned to Wednesday 3 August 2005 and was set down for a full week's hearing. Counsel agreed to a change of venue to the Auckland Racing Club, Ellerslie Racecourse, Auckland, on the grounds of convenience to both parties.
----A further telephone conference has been scheduled for 9.30 am on 10 June 2005 when any issues relating to disclosure that may still be outstanding will be further discussed.
