DECISION AND REASONS:

--

--

Following the running of Race 3, the Robbie’s Bar & Bistro Barringtons Mall Mobile Pace, an information was laid by Stipendiary Steward Mr N. M. Ydgren against Mr A. E. Veint, the driver of “Sally Patron” (13), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively and unnecessarily.

--

--

Mr Veint had indicated on the information that he admitted this breach of the Rule and also that he did not wish to attend the hearing.

--

--

Mr Ydgren gave evidence and used video coverage to show that Mr Veint had used his whip on about 25 occasions from about the 500 metre mark.  When spoken to Mr Veint accepted that his use of the whip did not look good.

--

--

Penalty:

--

--

In relation to penalty Mr Ydgren advised that Mr Veint was a Junior Driver, had no relevant previous convictions, and had admitted the breach.  A fine of $200-00 was recommended.

--

--

Taking into account the matters put forward by Mr Ydgren I was satisfied that a fine of $200-00 was appropriate in the circumstances.  Accordingly Mr Veint was fined the sum of $200-00.
