Following the running of Race 2, The Stock Xchange Café & Bar Handicap Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr N. P. Williamson, the driver of “Springbank Richard” (10), alleging a breach of Rule 869(3)(b).  The charge was that Mr Williamson drove carelessly with approximately 1500 metres to run when striking the wheel of “She Sells Sea Shells” (2) causing his own horse to break.



Following the running of Race 2, The Stock Xchange Café & Bar Handicap Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr N. P. Williamson, the driver of “Springbank Richard” (10), alleging a breach of Rule 869(3)(b).  The charge was that Mr Williamson drove carelessly with approximately 1500 metres to run when striking the wheel of “She Sells Sea Shells” (2) causing his own horse to break.

Mr Williamson had indicated on the Information that he admitted this breach of the Rules, and he confirmed this at the hearing.  Mr Williamson also agreed that he understood the charge and the Rule it was brought under.

Mr Ydgren gave evidence and used video coverage to show that at about the 1500 metre mark Mr M. R. De Filippi (“She Sells Sea Shells”) moved out in front of Mr Williamson, which he was entitled to do.  Mr Williams then restrained his horse to trail behind Mr De Filippi.  However Mr Williamson moved inwards too quickly and as a result struck a sulky wheel of “She Sells Sea Shells” with the result that his horse broke and lost its chance.

Mr Williamson explained that his horse was racing keenly at the time, and that this contributed to the incident.

Penalty:

In relation to penalty Mr Ydgren advised that Mr Williamson had one previous conviction under this Rule on 6 March 2009 at Winton when he was fined the sum of $250-00, but since then his record has been exemplary.  Taking this into account, and also taking into account that “Springbank Richard” lost its chance in the race, a fine of $350-00 was recommended.

Mr Williamson said that there were mitigating circumstances in this case, and that it was not a blatant case of careless driving.

We adjourned to consider the matter of penalty.  We looked at the Penalty Guide and previous penalties imposed in similar circumstances. We were satisfied that the fine recommended was appropriate in the circumstances.

On returning to the Enquiry Room we advised the parties that Mr Williamson would be fined the sum of $350-00.
