Hearing of information number 30189 instigating a protest under Rule 876(1) of the Rules of Racing alleging that "Coup Wellington" or its rider placed Third (3) by the Judge interfered with the chances of "Themadmarchhare" placed Fourth (4) by the Judge. The interference occurred near 200 metres.

DECISION:

--

Following the running of Race 8 a protest was lodged by Mr SC Ching, Stipendiary Steward, whereby he alleged that "Coup Wellington" (J Laking) caused interference to "Themadmarchhare" (L Young) near the 200 metres.

At the commencement of the hearing, this committee was concerned as to whether or not the connections of "Coup Wellington" were adequately represented as Mr PJ Williams the trainer, informed the Stipendiary Steward that he did not want to attend the hearing. Mr R Coupland, of Couplands Bakeries Limited, the owner of "Coup Wellington" was not on course. Mr J Laking, the jockey, advised that he was happy to represent the horse's connections.

Mr Ching presented video evidence of the incident which showed the field racing keenly for the finishing line. "Coup Wellington" was in the front line of horses with "Themadmarchhare" in close proximity. "Coup Wellington" moved out and presented a significant gap for "Themadmarchhare", which promptly began a forward movement into the gap. "Themadmarchhare" reached the hind quarters of "Coup Wellington" which then moved sharply inwards, coming into contact with "Themadmarchhare" and causing it to check. After a time, "Themadmarchhare" recovered and ran on keenly to finish three quarters of a length behind "Coup Wellington".

Mr Young the rider of "Themadmarchhare" had nothing to add to the video other than to confirm the interference that had occurred to her.

The official margins were:

1st to 2nd - ? head

--

2nd to 3rd - 2 lengths

--

3rd to 4th - ? lengths

--

Mr Laking, the rider of "Coup Wellington" told the committee that he did not think that all of the interference could be ascribed to him, because of outward movement of "Condore". He acknowledged that he had moved in, nevertheless.

In summing up, Mr Ching agreed that there had been some outward movement by "Condore" but that it was not as great as what Mr Laking would have us believe.

Discussion

--

In considering a protest, a judicial committee needs to look at the totality of the interference complained of, and in the process, to examine the build-up to the incident, the incident itself and the aftermath.

"The Build Up"

--

The field was in the last 200 to 300 metres from the finishing line and all horses were racing keenly. A gap was presented to "Themadmarchhare" which it commenced to take advantage of. "Themadmarchhare" was on a forward movement.

"The Incident"

--

As "Themadmarchhare" began its forward movement into the racing room which was presented, "Coup Wellington" moved sharply across inwards, coming into contact with "Themadmarchhare" and causing a significant check to "Themadmarchhare".

"The Aftermath"

--

The aftermath of the incident to "Themadmarchhare" was to affect it in its bid for the finishing line. "Themadmarchhare" lost ground which it then fought to recover. "Themadmarchhare" had its chances of finishing in a better place affected.

Our task, therefore, after considering the matters set out above, is to decide whether or not there was interference and if so, was it sufficient to warrant a change in the placings.

--

We have concluded that there was interference caused to "Themadmarchhare" by "Coup Wellington" when "Coup Wellington" came across the path of "Themadmarchhare" as described above. That interference caused a check to "Themadmarchhare" and affected its chances of finishing in a better position.

--

Having reached the conclusion that there was interference, we now turn to consider whether or not we should exercise our discretion to alter the placings. We are firmly of the view that the chances of "Themadmarchhare" were affected to such a degree by the actions of "Coup Wellington" that we must exercise our discretion in favour of "Themadmarchhare".

The protest is therefore upheld.
