Following the running of Race 3, the Robbie's Bar & Bistro Yaldhurst & New Brighton Mobile Pace, an information was laid by Stipendiary Steward Mr N. G McIntyre against Mr A. Soal, driver of Swamp Dweller (11), alleging a breach of Rule 869(3)(b). The charge was that Mr Soal drove carelessly

DECISION AND REASONS:

--

Following the running of Race 3, the Robbie's Bar & Bistro Yaldhurst & New Brighton Mobile Pace, an information was laid by Stipendiary Steward Mr N. G McIntyre against Mr A. Soal, driver of Swamp Dweller (11), alleging a breach of Rule 869(3)(b). The charge was that Mr Soal drove carelessly with about 700 metres to run when he allowed his horse to make contact with the sulky wheel of Just Ahead (16) resulting in his horse breaking and losing it's chance.

Mr Soal had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.

Mr Ydgren used video coverage to show this incident.

Mr Soal explained that coming up the straight his horse was "flat" and trying to keep up, and he "gave him a couple" to try and get him back up and going and then he over raced.

Penalty: In relation to penalty Mr McIntyre advised that Mr Soal had no previous convictions. A fine of $200-00 or a 3 day suspension was recommended.

Mr Soal said that he would prefer a suspension to a fine.

In considering the matter of penalty we were satisfied that the penalties recommended by Mr McIntyre were appropriate. We also took into account that Mr Soal preferred a suspension to a fine.

Accordingly Mr Soal's open horseman's licence was suspended from after the completion of racing on 26 January 2007 to after the completion of racing on 4 February 2007, this being a 3 day suspension.
