Following Race 7, a protest was lodged pursuant to Rule 876 (1) by the informant Mr P Taylor, rider of BELLA RUGER, placed 6th by the judge. He alleged that GALACTIC STORM placed 5th by the judge, caused interference to BELLA RUGER placed 6th by the judge

Following Race 7, a protest was lodged pursuant to Rule 876 (1) by the informant Mr P Taylor, rider of BELLA RUGER, placed 6th by the judge. He alleged that GALACTIC STORM placed 5th by the judge, caused interference to BELLA RUGER placed 6th by the judge. The margin between 5th and 6th was 3/4 length.

Mr Taylor demonstrated the video films and showed where upon entering the straight, his mount BELLA RUGER was racing on the inside of GALACTIC STORM and with clear room in front of him. Mr Taylor said it was his gap to take when GALACTIC STORM moved in severely shunting his mount, almost unseating him. He said he lost at least 2 lengths, which cost him at least 5th placing. He said it took him 100 metres to get balanced.

Mr Saad said it was GALACTIC STORM's first start in blinkers and he was trying to get him balanced around the turn when he ran in.

Mr Jenkins, trainer of GALACTIC STORM, said the horse was difficult and unruly.

Stipendiary Steward Mr Oatham, when asked for his assessment, said there was solid contact between the 2 runners which caused BELLA RUGER to lose at least 2 - 3 lengths and submitted the protest should be upheld.

DECISION

--

The Committee carefully considered all evidence and submissions. We are satisfied that BELLA RUGER did receive severe interference from GALACTIC STORM soon after entering the home straight. This interference clearly cost BELLA RUGER 2 - 3 lengths and after getting re-balanced he again suffered interference from GALACTIC STORM. In the last 150 - 200 metres it was clearly evident that BELLA RUGER was making ground on GALACTIC STORM to finish within 3/4 of a length of that runner. The Committee has no doubt that had BELLA RUGER not received the interference from GALACTIC STORM it would have finished in front of that horse.

Accordingly the protest is upheld and the placings are now :
