DECISION & REASON
--Following the running of Race 1 the Stipendiary Stewards laid and an information instigating a protest against horse number 14 Mentor placed 5th by the Judge, alleging that Mentor left its gait over the concluding stages of the race and not in its correct gait at the finishing post, when lapped on by horse number 3, Arbee.
----At the outset of the Hearing the Stipendiary Stewards confirmed Mr McNally's written advice that he did not contest the relegation on behalf of the connections of Arbee.
----The Stipendiary Stewards demonstrated the incident with the assistance of the video evidence. This showed over the competing stages of the race Mentor going roughly and then into a pace despite the attempts of Mr McNally to return him to his correct gait. It was still out of its correct gait at the finish.
----It is clear from the photo finish and the video evidence that Mentor was lapped on by Arbee.
----The protest is accordingly upheld and horse 14 is relegated from 5th placing to 6th placing with horse 3 promoted to 5th. The first six placings now read:
