FACTS:

Stipendiary Steward Mr M WILLIAMSON showed the video film of the race from the entrance to the home straight to the 200metre mark.  He said Mr ORMSBY struck his mount KIRRA SURF with the whip on 17 occasions prior to the 200metre mark, without the required respite of 6 strides between each use of the whip.  He said Mr ORMSBY’s use of the whip was well outside the guidelines.  Mr ORMSBY said he had been instructed by the trainer to try the horse hard because it tended to pull up.  He said he had no excuse and “got carried away”.

SUBMISSION(s) ON PENALTY:

Mr COLES said Mr ORMSBY had no whip breaches recorded against him since 2007.  He said the offending was in the mid to high range.  He submitted that a fine of $300 - $400 was appropriate.

Mr ORMSBY submitted that he should be fined $200 - $300.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr COLES and Mr ORMSBY, the offending was mid range on the scale of seriousness, Mr ORMSBY’s excellent record in relation to whip use, and other penalties recently imposed for a breach of this rule.

PENALTY:

--

Balancing the above matters and with emphasis on the excellent record of Mr ORMSBY in relation to whip use, a fine of $300 is imposed.
