Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr A Coles that shortly after the start TOBY MAGUIRE (T Russell) shifted inwards onto KILMARNA (A Peard), also taking the line of AT SEA (D Walsh) resulting in both runners being checked.

Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr A Coles that shortly after the start TOBY MAGUIRE (T Russell) shifted inwards onto KILMARNA (A Peard), also taking the line of AT SEA (D Walsh) resulting in both runners being checked.
--Mr Davidson demonstrated the video which showed Mr Russell on his mount TOBY MAGUIRE, shortly after the start, move inwards on to KILMARNA and taking the line of AT SEA resulting in checks to both horses.
--As Mr Russell had admitted the charge the committee is only required to adjudicate on penalty.
--PENALTY: Mr Coles gave Russell's record of one suspension in the previous 12 months, not including today, and asked for a suspension although he felt the offence was at the lower end of the scale.
--Mr Russell had nothing to add.
--After taking into account submissions, as well as the fact of Mr Russell being suspended earlier in the day until 3 March we impose a suspension beginning from the conclusion of racing on 3 March till the conclusion of racing on 14 March 2007.
