Decision: Rule 876 (1) : Ms Mundy, licensed jockey, initiated a protest after race 10, alleging that TURN THE PAGE or its rider placed second by the Judge caused interference to GOOD AS GOLD placed fourth by the Judge. The interference allegedly occurred in the final straight. Judges placings were 9, 5, 10, 2.  Margins were 2 1/2 L; 1L; 1L.

Rule 876 (1) : Ms Mundy, licensed jockey, initiated a protest after race 10, alleging that TURN THE PAGE or its rider placed second by the Judge caused interference to GOOD AS GOLD placed fourth by the Judge. The interference allegedly occurred in the final straight. Judges placings were 9, 5, 10, 2.  Margins were 2 1/2 L; 1L; 1L.

Present at the hearing were Ms A Mundy and Ms R Sissons, representing the connections of GOOD AS GOLD, and Mr J Misbah (with Mrs D Pitman assisting him), representing the connections of TURN THE PAGE. Mr Q Prendergast who was in charge of TURN THE PAGE, on the day, indicated that he had a financial conflict and he did not attend the protest.

Ms Mundy stated that there was outwards movement from TURN THE PAGE over the last 250 metres which forced her wider on the track. She said at the 100 metres until the 50 metres she had to stop riding as she was simply trying to keep her line.  She alleged that the interference from TURN THE PAGE had cost her at least the 2 lengths margin between 2nd and 4th.

Mr Misbah acknowledged that TURN THE PAGE had shifted out down the home straight but he stated that GOOD AS GOLD would not have beaten TURN THE PAGE.

Mr Davidson, stipendiary steward, when asked to comment, said Ms Mundy had brushed with Mr Misbah at the 250 metres but she had continued to ride out GOOD AS GOLD. He said she had received a check at the 50 metres and she had stopped riding her mount out fully.  He said the stewards were not satisfied that GOOD AS GOLD would have beaten TURN THE PAGE and the stewards had not brought the protest because of this.

To alter the placings we have to be of the opinion that GOOD AS GOLD would have beaten TURN THE PAGE had the interference not occurred. We are not so satisfied. While Ms Mundy was briefly inconvenienced at the 250 metres, and for a distance of some 100 metres she was forced to race wider on the track as a consequence of TURN THE PAGE drifting out, she did not stop riding.  We observe that both the second and third horses came from behind Ms Mundy. While she did have to stop riding and change her running line at the 100 metres for some 50 metres, we do not believe that without this interference GOOD AS GOLD would have beaten TURN THE PAGE. The margin of 2 lengths is simply too great to reverse the placings. The protest is therefore dismissed.
