Following Race 2 an Information was filed pursuant to Rule 605 (1).  The Informant Mr Coles alleged that Miss Vance failed to present herself on course to ride TAKE A RAIN CHECK by the required time.

FACTS:

--

Mr Coles explained to the committee that Miss Vance arrived too late to fulfil her engagement in Race 2 and had to be replaced.  Mr Coles said Miss Vance’s late arrival meant Mr Curtis, trainer of TAKE A RAINCHECK, was unable to find a rider to claim a 2 kg allowance which Miss Vance was entitled to.

Miss Vance said she misunderstood the race times causing her late arrival and she was entirely to blame.

SUBMISSION(s) ON PENALTY:

Mr Coles submitted a fine of $100 - $200 would be appropriate.  Miss Vance had nothing to say regarding penalty.

REASON(s):

--

The committee considered the evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Miss Vance’s guilty plea and her honesty and cooperation with the stewards.  However, as explained to Miss Vance, this breach constituted a broken riding engagement resulting in an inconvenience to punters and connections.

Accordingly we impose a fine of $200.
