Following the running of Race 10, the Avon City Ford Premier Quality, Mr G McKeon, a senior apprentice rider from Brisbane, was charged with careless riding.

DECISION AND REASON

--

Following the running of Race 10, the Avon City Ford Premier Quality, Mr G McKeon, a senior apprentice rider from Brisbane, was charged with careless riding. The Information alleged that he allowed his mount to shift inwards when not sufficiently clear causing "Spanish Class" to clip a heel and dislodge Mr Calder near the 200 metre mark. The fact situation was quite straightforward. "Spanish Class" ridden by Mr Calder was starting on a forward movement into a gap between Mr McKeon's mount and "Blaze ?n Rule" ridden by P Taylor. Mr McKeon went for his whip and as a consequence, his mount rolled inwards taking the line of "Spanish Class" which clipped the heels of "Nicholman" and stumbled, dislodging Mr Calder in the process. Mr McKeon admitted a breach of the Rule. In mitigation, he said that he was unaware of Mr Calder's presence and observed on the head on film that the gap for Mr Calder was marginal. Mr Moseley, assisting Mr McKeon, asked the committee to also take into account the slight outward movement of "Blaze ?n Rule" which made the gap between horses even narrower. It was pointed out that Mr McKeon took immediate action to straighten.

PENALTY DECISION

On the question of penalty, Mr Ching submitted that as Mr McKeon is an apprentice that a suspension would be appropriate. Mr McKeon told the hearing that he was last suspended in March 2005 for about eight or nine meetings. He said that as a senior apprentice he is able to pay a fine. In our opinion, however, the carelessness was relatively minor, and Mr McKeon was not assisted by the movement of his horse when under the whip. A rider was dislodged and that cannot be overlooked. In the circumstances, we conclude that a fine is appropriate in this case, which we set at $1,000.00.
