Decision: Following the running of the City of Auckland Cup Mr M. Coleman,rider of SO YOU,was charged with careless riding under rule 871(1)(d)

Following the running of the City of Auckland Cup Mr M. Coleman,rider of SO YOU,was charged with careless riding under rule 871(1)(d).  SO YOU was relegated from second to third after causing interference to WILLY SMITH  (M.Cameron).

Mr Coleman denied the charge.

Mr C.George (Chief Stipendiary Steward) used the head and side on films of the final 200 metres to assert that  Mr Coleman angled his horse out for a run outside the eventual winner,HIGHFLYING, and in doing so severely bumped and unbalanced  WILLY SMITH. He called Mr Cameron who stated that SO YOU was only about three quarters of a length in front of WILLY SMITH when Mr Coleman shifted out.

Mr Coleman vigorously asserted that there was movement from the horses on the inside of HIGHFLYING and that UPSTAGED in particular had shifted out and brushed his horse and forced him to change ground.He further asserted that the movement occurred too quickly for him to avoid contact with WILLY SMITH.

The Committee's view of the evidence and the films is that SO YOU's running line was not affected by the inside horses and there was certainly no contact with UPSTAGED. Mr Coleman clearly shifted out when insufficiently clear of WILLY SMITH and made no effort to mitigate the interference to that horse.We find the charge proved.

On the issue of penalty Mr George advised that Mr Coleman's carelessness was not at the high end of the scale and nor was the severity of the consequences.Although SO YOU was relegated Mr George acknowledged Mr Coleman's exemplary record and called for a minimum of three days suspension.

Mr Coleman advised he was last suspended in August 2005 and asked the Committee to note that he rode at most northern meetings.

The Committee in setting penalty took into account the Group 2 status of the race,the stake of $200,000,and the fact that Mr Coleman's actions led to the relegation of his horse with consequential financial detriment to the connections. The starting point in our view is a 3 week suspension. But we have given Mr Coleman considerable credit for his excellent riding record and further relief in the light  of Mr George's observations that this was not carelessness at the top end.

Taking these matters into account we suspend Mr Coleman from the close of racing on 2 January 2007 until the close of racing on 15 January 2007,an effective 2 week suspension.
