Following the running of Race 9, J W Sport Amateur Mobile Pace, an information was filed by Stipendiary Steward, Mr B D Williams, against Licensed Amateur Driver, Mrs L C Beagley, alleging a breach of Rule 869 (3) (a) in that Mrs Beagley, as the driver of ALLINGOODTIME “drove incompetently during this race in that she allowed her horse to race 4 wide for the majority of the event”.

Following the running of Race 9, J W Sport Amateur Mobile Pace, an information was filed by Stipendiary Steward, Mr B D Williams, against Licensed Amateur Driver, Mrs L C Beagley, alleging a breach of Rule 869 (3) (a) in that Mrs Beagley, as the driver of ALLINGOODTIME “drove incompetently during this race in that she allowed her horse to race 4 wide for the majority of the event”.

Mrs Beagley was present at the hearing of the information and indicated that she admitted the breach. The breach was found proved accordingly.

Rule 869 provides as follows:
(3)  No horseman shall in any race drive:-
     (a)  incompetently.

Mr Williams had Mr S P Renault, Stipendiary Steward, show a video replay of the Race, a mobile start event over the distance of 1950 metres. He pointed out ALLINGOODTIME, driven by Mrs Beagley, starting from barrier 4 on the front row. He showed ALLINGOODTIME, racing 4-wide, and showed other horses crossing in front of it. Mrs Beagley remained 4-wide and made no effort to go forward or to ease back.  The horse remained 4-wide, without cover, until approximately the 600 metres when it began to tire and drifted.

Mr Williams said that ALLINGOODTIME had had 37 lifetime starts before today and had 9 placings.  It was 3/7 in the order of favouritism for the Race.

Mrs Beagley said that she owned and trained ALLINGOODTIME. She informed the Committee that she had been driving in amateur drivers’ races for 4 years and had a clean record.  This was her worst driving effort and she readily admitted her breach.  The horse is a “very aggressive horse off the gate” and it was her intention to go forward. However, the horse was unable to cross.  She expected that another driver might concede but she did not wish to use this as an excuse, she said.  She accepted that this race was a “step up”.  Finally, she said, she knows the horse very well and it is very difficult to pull back.

In relation to penalty, Mr Williams acknowledged that this was Mrs Beagley’s first drive in a totalisator event.  However, the betting public was entitled to expect a better standard of driving, he said.  Notwithstanding Mrs Beagley’s lack of experience and her guilty plea, Mr Williams submitted that the appropriate penalty was that recommended in the JCA Penalty Guide – that is to say, a suspension for 3 months.

Mrs Beagley said that she had two horses in work in anticipation of driving them in totalisator races for amateur drivers.  She asked the Committee to consider a shorter period of suspension.

In determining penalty, the Committee took into account Mrs Beagley’s very frank admission of the breach and her lack of experience of driving at this level – this was her first drive in a totalisator race. However, the level of competence displayed by her on this occasion was well below that which the betting public could reasonably expect.  The Committee noted that the horse was quite well supported – 3/7 in the betting in the 12-horse field.  The Committee also noted the recommended starting point for breaches of the Rule as set out in the JCA Penalty Guide and referred to by Mr Williams.

Having regard to the above matters, the Committee suspended Mrs Beagley’s amateur driver’s licence up to and including 31 July 2009.
